Terms of use

Last updated: November 4, 2026 · EarnMyLicense.com

Short version: this is a free practice resource, not a government site and not the real test. Practising here helps you prepare, but no free content on this site guarantees you will pass. A paid Pass Guarantee tier is planned; it is not on sale yet, and its terms will be published on this page before it launches.

1. Accepting these terms

By using EarnMyLicense.com (“the site”), you agree to these Terms of Use. If you do not agree, please do not use the site. We may update these terms as described in Section 10; continuing to use the site after an update is posted means the updated terms apply.

2. What EarnMyLicense is — and is not

  • EarnMyLicense provides original practice questions, explanations, and exam simulators for driving knowledge tests, written by us from official driver handbooks.
  • It is a study aid only. It is not the official test, it does not issue licences or permits, it does not book tests, and it cannot change any government decision.
  • Not a government site. EarnMyLicense is an independent practice resource. It is not affiliated with, endorsed by, sponsored by, or connected to any government licensing authority — including the Ontario Ministry of Transportation and DriveTest, the California Department of Motor Vehicles, the Texas Department of Public Safety, the Florida Department of Highway Safety and Motor Vehicles, or the New York State Department of Motor Vehicles. Government names and handbook titles appear on this site only to identify the official publications our practice questions are based on.
  • For official rules, fees, eligibility, and booking, always use your jurisdiction’s official website and its current driver handbook. If anything on this site ever differs from the current official handbook, the handbook is correct.

3. No guarantee of passing — free content

Our practice tests and simulators are designed to mirror the format, question count, and pass mark of the real tests as closely as we can, and every answer is explained so you learn the underlying rule. However:

  • Using this site, completing any practice test, or scoring any result in our simulator does not guarantee that you will pass the official government test. Real test questions are not published, differ from ours, and your result on the day depends on many factors outside our control.
  • No statement on the free site — including our tagline, “Pass your driving test the first time” — is a promise, warranty, or guarantee of any individual result. It states the goal the site is built to help you work toward.
  • The only pass-related promise we will ever make is a paid Pass Guarantee, once it launches, and only on the exact terms published at that time. Nothing in the free tier creates a refund right.
  • Test formats, pass marks, fees, and rules change. We work to keep our content current, but we do not warrant that every question, timer, or stated pass mark matches the test as administered on any given day. Simulator timers are practice aids labelled as ours; real sittings may be untimed or timed differently.

4. Acceptable use

You may use the site for your own personal study. You agree not to:

  • Copy, scrape, republish, resell, or bulk-download our questions, explanations, sign artwork, or site design, except for brief personal study notes;
  • Misrepresent our practice material as official government material, or as the real test questions;
  • Interfere with the site’s operation, attempt to access it in an automated or abusive way, or use it for any unlawful purpose;
  • Remove copyright, trademark, or attribution notices from any permitted copy.

All site content — questions, explanations, text, logos, and original sign illustrations — is owned by EarnMyLicense or used with permission, and is protected by copyright and trademark law. Government handbook facts themselves (speed limits, rules, penalties) are facts and are not claimed as our property; our original wording and presentation of them are.

5. Accounts and data on your device

The free site has no accounts. Your progress and mistake list are stored only in your browser’s local storage, on your device, as described in our Privacy Policy. Because that data lives on your device, we cannot recover it if you clear your browser data, change devices, or use a different browser — and losing it does not create any claim against us.

6. Advertising

The free site is supported by advertising, including ads served by Google AdSense and other third-party vendors. Advertisements are the responsibility of the advertiser; the appearance of an ad does not mean we endorse the product or service. How advertising cookies work, and how to opt out of personalised advertising, is explained in our Privacy Policy.

7. Links to other sites

We link to official government pages, handbooks, and privacy opt-out pages for your convenience. We do not control those sites and are not responsible for their content, availability, or privacy practices.

8. Availability, accuracy, and liability

  • The site is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose.
  • We may change, suspend, or discontinue any part of the site at any time.
  • To the maximum extent permitted by law, EarnMyLicense’s total liability arising from your use of the free site is limited to CAD $50. Nothing in these terms limits liability that cannot lawfully be limited, and nothing in these terms affects your statutory consumer rights.
  • Road safety: this site teaches the rules as written in official handbooks. It is not driving instruction, and passing any test — ours or the government’s — does not by itself make anyone a safe driver. Always drive according to the law and conditions.

9. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. Any dispute will be brought in the courts of Ontario, unless applicable consumer law gives you the right to proceed in your own jurisdiction, in which case that right is preserved. If any part of these terms is found unenforceable, the rest continues in effect.

10. Changes to these terms

The current version will always be posted at earnmylicense.com/terms/ with a new “Last updated” date. Material changes will also be announced with a notice on the home page for at least 14 days. Changes will never retroactively reduce a Pass Guarantee already purchased — a purchase keeps the guarantee terms shown when it was bought.
